  • Capsize, entanglement in lines or equipment, and being trapped or held under the sail or hull.
  • Collision with other sailing boats, RIBs and support vessels, ferries, powerboats, wash, moorings, pontoons, rocks or the seabed.
  • Slipping, falling or lifting injuries when launching, recovering, rigging or carrying equipment, and when boarding or leaving a pontoon or RIB.
  • Wind gusts, changing weather, strong tides and sea conditions.
  • Sun, heat, dehydration, cold water, exhaustion and overexertion.

Part 4: Important notice about your rights

Please read this carefully. The Australian Consumer Law gives you a right to expect recreational services to be provided with due care and skill. By signing, you agree to exclude, restrict or modify that right so that the Organisers are not liable for the death or personal injury you may suffer, or that anyone else may suffer because of you, as a result of a failure to provide the recreational services with due care and skill. Personal injury includes mental and nervous shock. This applies to the extent permitted by law.

Part 5: Release of liability

To the maximum extent permitted by law, including section 5N of the Civil Liability Act 2002 (NSW) and section 139A of the Competition and Consumer Act 2010 (Cth), I release the Organisers and their officers, directors, employees, instructors, volunteers and agents from all liability for my death or personal injury, including injury from negligence, arising from my participation in this event.

This release does not apply where the death or personal injury is caused by reckless conduct, as defined in section 139A of the Competition and Consumer Act 2010 (Cth). It does not limit any right I have that the law does not allow to be excluded.

I understand this release only covers death and personal injury. It does not apply to loss of or damage to my property.
